This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, which require publishing the rules and regulations, privacy policy, and Terms of Use for access or usage of the domain name [www.shaguncoins.in] including any related mobile site or application (collectively referred to as the “Platform”).

The Platform is owned and operated by Shagun Coins, a proprietorship registered under the relevant laws of India, having its registered office at B-95, Flatted Factory Complex, Okhla Phase 3(hereinafter referred to as the "Platform Owner", "we", "us", or "our").

Your access to and use of the Platform and related services and tools are governed by the following terms and conditions ("Terms of Use"). By accessing, browsing, or transacting on the Platform, you agree to be bound by these Terms of Use, including all policies referenced herein.

1. Eligibility and User Obligations

1.1. You must be at least 18 years of age and legally competent to enter into a binding contract to use the Platform.

1.2. You agree to provide accurate, current, and complete information during registration and maintain and update such information to keep it accurate.

1.3. You shall be solely responsible for maintaining the confidentiality of your account information and password and for all activities under your account.

2. Services

2.1. Shagun Coins offers products including but not limited to gold and silver coins and other precious metal products (collectively, “Products”) for sale via the Platform.

2.2. All transactions through the Platform are subject to availability, verification of pricing, and acceptance by us.

3. Pricing, Payment, and Product Details

3.1. Prices displayed on the Platform are calculated dynamically based on real-time metal rates (gold per 10g, silver per 1kg) and product-specific markups. Prices are inclusive of applicable taxes unless otherwise stated.

3.2. We reserve the right to modify product pricing or descriptions at any time without prior notice.

3.3. Payment for purchases must be made through approved payment gateways. We do not store or process payment details on our servers.

3.4. In case of a pricing or typographical error on the Platform, we reserve the right to cancel any orders placed for the incorrect price, even if the order has been confirmed.

4. Order Fullfillment and Shipping

4.1. Orders will be processed upon successful receipt of payment. Order confirmation will be sent via email or SMS.

4.2. We aim to dispatch products within [1–2 business days]. Delivery timelines may vary based on location and courier service.

4.3. Title and risk of loss for all products pass to the buyer upon delivery to the carrier.

5. Returns, Replacements, and Refunds

5.1. Due to the sensitive nature of precious metals, we do not accept returns or exchanges unless the product is defective or incorrect.

5.2. Any claims regarding damaged or incorrect products must be made within 24 hours of delivery and must be supported by an unboxing video and photographs.

5.3. Upon verification, eligible refunds or replacements will be processed within 7 business days.

6. Intellectual Property Rights

6.1. All content available on the Platform, including text, graphics, logos, images, design, layout, and software, is the intellectual property of the Platform Owner or its licensors.

6.2. You are not permitted to use, reproduce, or distribute any content from the Platform without prior written permission from the Platform Owner.

7. Prohibited Uses

You agree not to use the Platform for any unlawful purpose or in any way that:

Violates any applicable local, state, national or international law;
Infringes upon the intellectual property rights of the Platform or any third party;
Interferes with or disrupts the Platform or servers/networks connected to it;
Attempts to gain unauthorized access to any portion of the Platform.

8. Third-Party Links

The Platform may contain links to third-party websites. These links are provided for your convenience and information only. We do not endorse and are not responsible for the content, terms, or practices of such third-party sites.

9. Limitation of Liability

In no event shall the Platform Owner be liable for any indirect, incidental, special, or consequential damages (including loss of profits, data, or goodwill), even if we have been advised of the possibility of such damages, arising out of or in connection with the use or inability to use the Platform or Services.

Our liability shall in any case be limited to the amount paid by you for the product or ₹100 (Rupees One Hundred Only), whichever is lower.

10. Indemnity

You agree to indemnify and hold harmless the Platform Owner, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of your violation of these Terms or applicable laws.

11. Force Majeure

The Platform Owner shall not be held liable for any failure or delay in performance of its obligations due to events beyond its reasonable control, including but not limited to acts of God, war, pandemics, natural disasters, or power failures.

12. Governing Law and Jurisdiction

These Terms of Use and any dispute arising therefrom shall be governed by the laws of India. Subject to arbitration (if applicable), all disputes shall be subject to the exclusive jurisdiction of the courts located at Delhi.

13. Amendments to Terms

We reserve the right to revise these Terms at any time without prior notice. It is your responsibility to review these Terms periodically. Continued use of the Platform shall be deemed acceptance of the revised Terms.
